The Economic and Financial Crimes Commission (EFCC), has described as “shocking” and “curious” Thursday’s ruling by a Federal Capital Territory (FCT) High Court, granting bail to Governor Ayodele Fayose’s close associate, Mr. Abiodun Agbele.

Justice Kayode Adeniyi of an FCT High Court Thursday, acquitted Agbele, who has been in the custody of the Commission, over fraud-related allegations.

In his ruling, Justice Adeniyi had held, inter alia, that the failure of the anti-graft agency to charge the suspect to court after his arrest, amounted a violation of his fundamental right.

Arising from that conclusion, therefore, the judge awarded N5 million damages against the Commission. But, the EFCC has vowed to file a motion for stay of execution of the ruling, as well as an appeal at the appellate court.

The Commission’s position was contained in a statement by its spokesman, Mr. Wilson Uwujarem.

It said its decision to challenge the ruling on appeal, is informed by the fact that it had placed material evidence before the court, to demonstrate that Agbele was being held on the strength of valid remand orders, from courts competent jurisdictions.
