A man in Zimbabwe has been arrested and charged for beating his brother to death after catching him with having sex with his wife.

A man from the Zvishavane region in Zimbabwe who caught his brother having sex with his wife on his matrimonial bed has been arrested and charged before the Gweru Court with culpable homicide after he allegedly beat the brother to death, reports MyZimbabwe.

29-year-old Gatsha Masotsha, who works in Bulawayo, a distance of about 185 kilometers, had travelled to his rural home in Zvishavane to visit his wife and family but met the shock of his life when he found his brother, Aleck Masotsha Moyo, in his bedroom having sex with his wife.

The angry Masotsha reportedly descended on the brother and assaulted heavily him before letting him go but the victim was found dead the following morning in his own room.

But Masotsha, through his lawyer, Brian Dube, successfully challenged the culpable homicide charge and it was reduced to a lesser charge of assault, arguing that he attacked his late brother in the dark as an intruder and only realised it was him after the fight.

He further told the court that he was not negligent in causing Moyo’s death as their fight was a result of an attack by an unknown stranger.

The prosecutor had told the court that upon arrival, Masotsha met his brother on his wife an a fight ensued between them.

“The accused assaulted the deceased with fists and booted feet all over the body. He went on to hit the deceased’s head against the floor and wall before grabbing a wood drill in the dark and using it to strike him.

He then grabbed a rope in the room and tied the deceased before looking for light and realised it was his brother."

Moyo allegedly confessed that he had a sexual affair with his brother’s wife.

After the discovery, Masotsha then untied Moyo and ordered him to go and sleep in his room so that they could discuss the matter as a family the following morning but he was found dead in his room the following morning and a report was made to the police leading to Masotsha’s arrest.
