Chairman of the Oyo State governorship petition tribunal, Justice F. C. Obieze, has warned litigants that time wasting will not be tolerated by the court, remarking that whoever does that is to his own detriment.
Justice Obieze gave this warning at the resumed hearing of the petition filed against the victory of Senator Isiaka Ajimobi of the All Progressive Congress (APC) by Senator Rashidi Ladoja, governorship candidate of Accord, in the April 11 governorship election in Oyo State.
Justice Obieze said that a case can only be won by merit and not on technicalities and urged lawyers concerned to brace up for longer hours of sitting as time was far spent and the tribunal was time-bound.
However, the pre-hearing could not commence Thursday, as lawyers to all parties were yet to file form TF008 (pre-hearing information sheet).
Lawyers to the petitioners, Senator Rashidi Ladoja and Accord, were represented by R.A. Ogunwole (SAN) and others, while M.O, Adebayo held brief for Wole Olanipekun (SAN) for the first respondent, Senator Isiaka Ajimobi; Rotimi Akeredolu (SAN) represented the second respondent; All Progressive Congress (APC); Adebayo Shobanjo and others represented INEC and Mr Rufus Akeju third and fourth respondents respectively.
The lawyers told the court that they received their notice for pre-hearing on 15June, and they were yet to file form TF008. Since all parties have seven days to respond to the notice for pre-hearing, Justice Obieze adjourned sitting to Tuesday, 23 June for pre-hearing trial.
