
Gov. Ayodele Fayose
The Court of Appeal sitting in Ado Ekiti, the Ekiti State capital, on Monday, adjourned for judgment in the appeal filed by the All Progressives Congress (APC) against the judgment of the election petition tribunal on the June 21 governorship election in the state.
The APC had challenged the result of the governorship election in the state, won by Governor Ayo Fayose, claiming that the election was rigged.
The APC also claimed that Governor Fayose was not qualified to stand election, saying he was allegedly impeached from office on October 16, 2006.
The five-man panel, led by Justice Abdu Aboki, adjourned for judgment after counsel for all the parties in the matter had made their submissions before it on Monday.
Counsel for the APC, Mr Hakeem Afolabi, had adopted and relied on briefs earlier filed on behalf of the APC in the proceedings and prayed the court to allow the appeal and grant all the reliefs sought by the appellants.
Afolabi called the attention of the appeal court judges to paragraphs 110-120 and 125a of the petition that were struck out by the lower tribunal, which, he said, bordered on the qualification of Fayose, who was the second respondent.
According to him, the reason given by the lower tribunal could not be accommodated under Section 138 (a) of the Electoral Act and insisted that there was no time limit to raise an issue that bordered on qualification of a candidate.
