The Federal High Court in Abuja has adjourned judgment in a suit seeking to restrain David Mark and Rauf Aregbesola from acting as National Chairman and National Secretary of the African Democratic Congress (ADC) to April 14, 2026.
The ruling, initially scheduled for Monday, was postponed by Justice Musa Suleiman Liman due to other official engagements. The adjournment was announced by a court registrar to journalists and party members who had gathered at the court premises ahead of the anticipated judgment.
The suit was instituted by Leke Abejide, a member of the House of Representatives representing Kogi State under the ADC platform. Filed on February 15, 2026 (FHC/ABJ/CS/1637/2025), the case lists the ADC, Ralph Nwosu, Mark, Aregbesola, and the Independent National Electoral Commission (INEC) as defendants.
Abejide is seeking, among other reliefs, a declaration nullifying the transfer of the party’s leadership from Nwosu to Mark and Aregbesola, which he claims occurred on July 2, 2025, in Abuja. He argues that the process was unlawful and violated provisions of the Electoral Act, 2022. He also seeks an order restraining both men from presenting themselves as party leaders, as well as an injunction preventing INEC from recognising them in those capacities.
However, the defendants have urged the court to dismiss the suit, contending that the matter pertains to the internal affairs of a political party and is therefore not justiciable. They further argued that Abejide lacks the legal standing to institute the action.
According to the defence, the current leadership emerged from a National Executive Committee meeting held on July 29, 2025, and not from the July 2 event cited by the plaintiff. They also maintain that the suit lacks merit and have asked the court to dismiss it with substantial costs.
The court had fixed April 13 for judgment after counsel to all parties adopted their final written addresses. The case will now be decided on April 14.
