Court strikes out former governor’s suit.

A suit filed by former Governor of Kogi state, Idris Wada, challenging the constitution of a judicial commission of inquiry by incumbent Governor Yahaya Bello to probe former regimes for lack of merit, has been struck out by an High Court sitting in Lokoja.

According to Ceoafrica, Justice Henry Olusiyi of High Court II, while delivering his judgement held that Governor Bello had the constitutional right and powers as enshrined in Section 2(1) of the Commission of Inquiry Law, Cap. 25 of the Laws of Northern Nigeria, 1963, to set up or constitute a commission of inquiry into the conduct of public officers.

‘‘I am fully satisfied that one of the reasons for Section 2(1) of the law is to empower a sitting governor to probe the administration of any past governor for public welfare.

‘‘I cannot see anything in the way and manner the judicial commission of inquiry was set up that shows that the claimant’s civil rights and obligations and right to fair hearing will not be guaranteed”, the judge said.
